CHAPTER 607 (House Bill 450) AN ACT concerning Fire Prevention Commission - Authority FOR the purpose of permitting the Fire Prevention Commission to
make recommendations to the Secretary of Public Safety and
Correctional Services on the daily operations of the Fire
Marshal's Office; and providing that the Fire Prevention
Commission does not have direct line authority over the Fire
Marshal's Office. BY repealing and reenacting, without amendments, Article 38A - Fires and Investigations Section 1, 3, 4, 5, and 6 Annotated Code of Maryland (1978 Replacement Volume and 1982 Supplement)
BY repealing and reenacting, with amendments, Article 38A - Fires and Investigations Section 2 and 7 Annotated Code of Maryland (1978 Replacement Volume and 1982 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article 38A - Fires and Investigations 1. (a) There is hereby created a State Fire Prevention
Commission, which shall consist of 9 persons, qualified by
experience and training to deal with the matters which are the
responsibilities of the Commission, appointed by the Secretary of
Public Safety and Correctional Services, with the approval of the
Governor. The Commission shall be part of the Department of
Public Safety and Correctional Services. The term of office of
the members first taking office shall expire as designated by the
Governor at the time of appointment, one at the end of one year,
one at the end of two years, one at the end of three years, two
at the end of four years, and two at the end of five years. Each
succeeding term shall be for five years, and any member is
subject to removal by the Secretary of Public Safety and
Correctional Services, with the approval of the Governor at any
time for neglect of his duties or for other cause which in the
opinion of the Secretary makes his continued membership unwise in
