1900 LAWS OF MARYLAND
(a)  This section does not apply if its application would
cause the State to lose or be denied any federal assistance or
funds otherwise available. (b)  (1) [All] THE DEPARTMENT SHALL APPROPRIATE ALL federal
grants, loans, or other funds available to the Department that
are to be spent on sewerage systems in the Patuxent River
watershed area [shall be appropriated by the Department as
follows: (1)  Available funds shall be appropriated] for use in
upgrading and floodproofing existing sewerage systems, collector
lines, or facilities in the area to meet standards currently in
effect pursuant to this subtitle. Available funds may not be
appropriated for use in constructing any new systems, collector
lines, or facilities in the area if the funds could be utilized
to upgrade and floodproof any existing systems, collector lines,
or facilities in the area. (2)  Notwithstanding paragraph (1) of this subsection,
available funds may be appropriated for construction of new
systems, collector lines, or facilities that will not require
discharge into a river, including on land disposal systems. 9-228. The Secretary is hereby designated as the State Water
Pollution Control Agency in the State of Maryland for the
purposes of Public Law 660 (84th Congress), which amended the
Federal Water Pollution Control Act, as this act and Public Law
660 may be amended from time to time, providing grants to the
states to assist them in meeting the cost of establishing and
maintaining adequate measures for the prevention and control of
water pollution, including grants for the construction of
necessary treatment works to prevent the discharge of untreated
or inadequately treated sewage or other waste into any water, and
for the purpose of related reports, plans, and specifications.
The Secretary is hereby given the powers necessary for the
Secretary to comply, as the State Water Pollution Control Agency
to represent the State of Maryland, with the provisions and
requirements of Public Law 660 and the FEDERAL Water Pollution
Control Act, as amended from time to time. No other State agency
shall exercise the powers hereby vested in the Secretary. 9-342. (a) In addition to being subject to an injunctive action
under this subtitle, a person who violates any provision of this
subtitle or of any rule, regulation, order, or permit adopted or
issued under this subtitle is liable to a civil penalty not
exceeding $10,000, to be collected in a civil action brought by
the Department. Each day a violation occurs is a separate
violation under this [section] SUBSECTION. 9-652.
