CHAPTER 567
(House Bill 302)
AN ACT concerning
Catching Soft-Shell Clams - Kent County and Anne Arundel County
FOR the purpose of amending a certain distance from the high
watermark in Kent County and Anne Arundel County within
which soft-shell clams may be caught; and generally relating
to the catching of soft-shell clams in Kent County and Anne
Arundel County.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
4-1037.
A person may not catch or attempt to catch soft-shell clams
with a hydraulic clam dredge or any other gear except hand-held
tools, such as shovels and hoes, in the following areas:
(5) Within 50 feet of the mean high watermark of any
shoreline in Calvert, Queen Anne's , KENT, Talbot, or Somerset
counties; within 300 feet in Anne Arundel[,] OR Dorchester[, or
Kent ] counties; or within 150 feet in St. Mary's County OR KENT
COUNTIES;
(5) (I) Within 50 feet of the mean high watermark of
any shoreline in Calvert, Queen Anne's, Talbot, or Somerset
counties;
(II) [within] WITHIN 300 feet in [Anne
Arundel,] Dorchester [, or Kent counties] COUNTY; or

(III) [within] WITHIN 150 feet in ANNE ARUNDEL
COUNTY, St. Mary's County, OR KENT COUNTY DOWNRIVER FROM NICHOLS
POINT AT THE EASTERN SIDE OF THE MOUTH OF LANGFORD CREEK AND
WITHIN 300 FEET UPRIVER FROM NICHOLS POINT;

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
