In paragraph (1) of this subsection, "publicly or
privately owned or operated" is new language added for
clarity and to conform to the administrative practice
of the Department. Since former HE § 9-501(r) did not
limit the right of any person or the public to own or
operate a water supply system, no change of substance
is intended by this addition.
In paragraph (l)(ii) of this subsection, the reference
to "or intended to be used" is new language added for
clarity. This reference expands the definition of
"water supply system" to conform to the definition of
"sewerage system" in subsection (m) of this section.
It is brought to the attention of the General Assembly
that, even though a water supply system that is
intended to be used is not required to be included in
a county plan, the Department requires each planned
water supply system to have a permit before its
construction can begin.
In paragraph (2) of this subsection, "plumbing system"
is substituted for the former reference to "piping or
fixtures", for clarity.
REVISOR'S NOTE TO SECTION: Former HE § 9-501(b), which
defined "approving authority" to mean certain
officials, agents, or agencies of local government
designated by the local governing body or specified by
other provisions of the former subtitle to carry out
this subtitle, is deleted as unnecessary since that
defined term is not used in this subtitle as revised.
9-502. SCOPE OF SUBTITLE.
(A) SYSTEMS NOT REQUIRING WATER FOR HUMAN OR ANIMAL
CONSUMPTION.
THIS SUBTITLE DOES NOT PROHIBIT THE INSTALLATION OR
OPERATION OF A WATER SUPPLY SYSTEM THAT IS USED ONLY TO SUPPLY
WATER FOR PURPOSES OTHER THAN HUMAN OR ANIMAL CONSUMPTION.
(B) COUNTIES EXEMPT FROM SUBTITLE.
IF A COUNTY IS EXEMPT FROM THE PROVISIONS OF THIS SUBTITLE,
THE COUNTY MAY NOT RECEIVE FUNDS FROM THE SANITARY FACILITIES
FUND.
(C) CONFLICT WITH OTHER LAWS, RULES, OR REGULATIONS.
ANY RULE OR REGULATION ADOPTED UNDER THIS SUBTITLE DOES NOT
LIMIT OR SUPERSEDE ANY OTHER COUNTY, MUNICIPAL, OR STATE LAW,
RULE, OR REGULATION THAT PROVIDES GREATER PROTECTION TO THE
PUBLIC HEALTH, SAFETY, OR WELFARE.
