RESTORATION OF THE REGIONAL FACILITY AND ITS ENVIRONS DURING THE
OPERATIONAL AND POST-CLOSURE PERIOD. D. THE LIABILITY OF THE COMMISSION'S FUND, INSURANCE
ENTITY, OR ANY OTHER MEANS OF COMPENSATION SHALL BE LIMITED TO
THE AMOUNT CURRENTLY CONTAINED THEREIN; PROVIDED THAT THE
COMMISSION MAY SET SOME LOWER LIMIT TO ENSURE THE INTEGRITY AND
AVAILABILITY OF THE FUND OR OTHER ENTITY FOR LIABILITY. 7-310. ARTICLE X.
SEVERABILITY AND CONSTRUCTION THE PROVISIONS OF THIS COMPACT SHALL BE SEVERABLE, AND IF
ANY PHRASE, CLAUSE, SENTENCE OR PROVISIONS OF THIS COMPACT IS
DECLARED BY A FEDERAL COURT OF COMPETENT JURISDICTION TO BE
CONTRARY TO THE CONSTITUTION OF THE UNITED STATES OR THE
APPLICABILITY THEREOF TO ANY GOVERNMENT, AGENCY, PERSON OR
CIRCUMSTANCE IS HELD INVALID, THE VALIDITY OF THE REMAINDER OF
THIS COMPACT AND THE APPLICABILITY THEREOF TO ANY OTHER
GOVERNMENT, AGENCY, PERSON OR CIRCUMSTANCE SHALL NOT BE AFFECTED
THEREBY. THE PROVISIONS OF THIS COMPACT SHALL BE LIBERALLY
CONSTRUED TO GIVE EFFECT TO THE PURPOSES THEREOF.
SECTION 2. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason, the invalidity shall
not affect the other provisions or any other application of this
Act which can be given effect without the invalid provisions or
application, and to this end all the provisions of this Act are
declared to be severable.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983. Approved May 31, 1983.
CHAPTER 516 (House Bill 1287) AN ACT concerning Fishing - Striped Bass - Legal Size FOR the purpose of altering the minimum size of striped bass
under which a person may not sell, offer to sell or buy, or
possess; and authorizing the Department of Natural Resources
to promulgate by regulation certain alternative lawful sizes
