investigation be made prior to withholding by the Comptroller of any refund amount; and providing that any administrative appeal to the Income Maintenance Administration occur after the withholding by the
Comptroller. BY repealing and reenacting, with amendments, Article 88A - Social Services Administration Section 59(e) Annotated Code of Maryland (1979 Replacement Volume and 1982 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article 88A - Social Services Administration 59. (e) (1) The bureau may certify to the Comptroller any
person whose court-ordered support obligations are more than 60
days in arrears. The certification may be made annually. The
obligor shall be notified of the certification [and the right of
immediate appeal to the Income Maintenance Administration in the
manner and form prescribed by regulation] AND THE OPPORTUNITY TO
REQUEST AN INVESTIGATION BY THE BUREAU. (2) (I) UPON RECEIPT OF A REQUEST FOR AN
INVESTIGATION FROM AN OBLIGOR WHO DISPUTES THE EXISTENCE OR
AMOUNT OF THE ARREARAGE REPORTED TO THE COMPTROLLER, THE BUREAU
SHALL CONDUCT AN INVESTIGATION TO DETERMINE THE CORRECTNESS OF
THE CERTIFICATION. (II) IF THE BUREAU DETERMINES UPON
INVESTIGATION THAT THE CERTIFICATION IS IN ERROR, IT SHALL, AS
APPROPRIATE, CORRECT OR WITHDRAW THE CERTIFICATION. [(2)] (3) The certification shall include the
following information, if known: (i) The full name and address of the obligor,
and any other names known to be used by that person. (ii) The social security number of the obligor. (iii) The amount of accumulated arrearage of
the support obligation. [(3)] (4) This subsection applies if the obligor is
more than 60 days behind in support payments as required by the
most recent court order; and (i) The State has received an assignment of
rights pursuant to § 48(2) of this article; or
