law; providing for certain permit provisions and regulations
which Prince George's County may or may not adopt; providing
for certain application, approval, and review procedures to
be followed by WSSC and Prince George's County; providing
for certain emergency situations when WSSC need not obtain a
permit before beginning construction or maintenance work;
providing for certain situations when Prince George's County
may make repairs to restore property disturbed by WSSC and
charge the cost to WSSC; and generally relating to permit
requirements for WSSC when entering upon a public highway in
Prince George's County to install, maintain, operate, or
construct a WSSC system.
BY repealing and reenacting, with amendments,
Article 67 - Washington Suburban Sanitary District
Section 10-101 and 10-102
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 67 - Washington Suburban Sanitary District
10-101.
(a) The WSSC may:
(1) Enter on a public roadway to install, maintain,
and operate the WSSC system; and
(2) Construct a water main, sewer, or drain or any
appurtenance of a water main, sewer, or drain in a public
roadway:
(i) In Prince George's County, [without the
receipt of a permit or payment of a charge] SUBJECT TO THE PERMIT
AND REGULATION PROVISIONS OF §§ 10-102 AND 10-103 OF THIS TITLE;
and
(ii) In Montgomery County, subject to the
permit and regulation provisions of §§ 10-102 and 10-103 of this
title.
(b) If a public roadway is to be disturbed, the WSSC shall:
(1) Notify the State, county, or municipality that
has authority over the public roadway of the WSSC's plans;
(2) Repair and leave the public roadway in the same
or a superior condition to that existing before the public
roadway was disturbed by the WSSC;
