(I) USED DURING AN EMERGENCY SITUATION; OR
(II) ORDERED BY A PHYSICIAN OR PSYCHOLOGIST AS
PART OF A MODE OR COURSE OF TREATMENT AND DOCUMENTED
CONTEMPORANEOUSLY IN WRITING; OR
(III) DIRECTED BY A REGISTERED NURSE IF A
PHYSICIAN'S OR PSYCHOLOGIST'S ORDER IS OBTAINED WITHIN 8 HOURS OF
THE ACTION.
(I) USED ONLY DURING AN EMERGENCY WHERE THE
INDIVIDUAL PRESENTS A DANGER TO THE LIFE OR SAFETY OF THE
INDIVIDUAL OR OF OTHERS; AND
(II) DIRECTED BY A REGISTERED NURSE IF A
PHYSICIAN'S ORDER IS OBTAINED WITHIN 2 HOURS OF THE ACTION; OR
(III) ORDERED BY A PHYSICIAN IN WRITING AS PART
OF A MODE OR COURSE OF TREATMENT.
(4) BE PROTECTED FROM HARM OR ABUSE AS PROVIDED IN
THIS SUBTITLE.
(C) (D) (1) SUBJECT TO THE PROVISIONS OF § 4-302 OF THIS
ARTICLE, § 9-109 OF THE COURTS AND JUDICIAL PROCEEDINGS ARTICLE,
OR ANY OTHER PROVISION OF LAW, THE RECORDS OF EACH INDIVIDUAL IN
A FACILITY OR A VETERAN'S ADMINISTRATION HOSPITAL ARE
CONFIDENTIAL.
(2) THE LAWYER OR THE LAWYER'S DESIGNEE REPRESENTING
AN INDIVIDUAL IN A FACILITY OR A VETERANS' ADMINISTRATION
HOSPITAL SHALL HAVE ACCESS, WITH THE WRITTEN CONSENT OF THE
INDIVIDUAL, TO THE INDIVIDUAL'S RECORDS IN THE COURSE OF SERVING
THE INDIVIDUAL.
(3) AN INDIVIDUAL WHO IS CURRENTLY OR WAS FORMERLY
TREATED IN A FACILITY SHALL HAVE ACCESS TO THAT INDIVIDUAL'S
RECORDS IN ACCORDANCE WITH § 4-302 OF THIS ARTICLE.
(4) FOR PURPOSES OF THIS SUBSECTION, THE PROVISIONS
OF § 4-302 OF THIS ARTICLE SHALL ALSO APPLY TO A FACILITY.
10-702.
(A) ON ADMISSION TO A FACILITY OR VETERANS' ADMINISTRATION
HOSPITAL AND PERIODICALLY THEREAFTER, AN INDIVIDUAL SHALL BE TOLD
OF THE RIGHTS PROVIDED IN THIS SUBTITLE IN LANGUAGE OR TERMS THAT
ARE APPROPRIATE TO THE INDIVIDUAL'S CONDITION AND ABILITY TO
UNDERSTAND.
(B) A FACILITY SHALL POST NOTICES IN ACCESSIBLE LOCATIONS
DESCRIBING THE RIGHTS PROVIDED IN THIS SUBTITLE IN LANGUAGE AND
TERMS THAT MAY BE READILY UNDERSTOOD.
