AN ACT concerning
Attorney General - Representation in Antitrust Matters
FOR the purpose of permitting the Attorney General to represent,
in his discretion, political subdivisions of this State,
their employees, officers, and agents in proceedings brought
under the federal and State antitrust laws; permitting the
Attorney General to render advice relating to the antitrust
laws to political subdivisions and their employees,
officers, and agents; providing for the reimbursement of the
General Fund of the State for the actual costs incurred by
the Attorney General in defending political subdivisions in
certain court and administrative proceedings; and providing
that a political subdivision, its employees, officers, and
agents, may select counsel of their choice.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 32A - Department of Law
12J.
THE ATTORNEY GENERAL MAY REPRESENT AND RENDER ADVICE TO ANY
POLITICAL SUBDIVISION OF THIS STATE, ITS EMPLOYEES, OFFICERS, OR
AGENTS IN STATE AND FEDERAL ANTITRUST LAW MATTERS, INCLUDING
DEFENDING THEM IN ANY SUCH ACTION OR ADMINISTRATIVE PROCEEDING.
IN ANY CASE WHERE THE ATTORNEY GENERAL ACTUALLY DEFENDS A
POLITICAL SUBDIVISION IN COURT OR IN ANY ADMINISTRATIVE
PROCEEDING, THE ATTORNEY GENERAL MAY REQUIRE THE POLITICAL
SUBDIVISION TO REIMBURSE THE GENERAL FUND OF THE STATE FOR THE
ACTUAL COSTS OF THE DEFENSE. NOTHING IN THIS SECTION SHALL BE
CONSTRUED TO DEPRIVE ANY POLITICAL SUBDIVISION OR ITS EMPLOYEES,
OFFICERS, OR AGENTS OF THE RIGHT TO SELECT COUNSEL OF THEIR OWN
CHOICE AT THEIR OWN EXPENSE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
