1254                                             LAWS OF MARYLAND                                        Ch. 394 SHALL BE ADJUSTED WITHIN A REASONABLE TIME OF THE AVAILABILITY OF
ACTUAL DATA FOR THAT 3 MONTH PERIOD. (D) IF REVENUES TO THE STATE GENERAL FUND FROM LOTTERY GAME
OPERATIONS DURING THE 1984 FISCAL YEAR ARE LESS THAN
$209,585,000, THEN THE DIFFERENCE BETWEEN THE ACTUAL REVENUES TO
THE STATE FROM LOTTERY OPERATIONS IN THAT PERIOD AND $209,585,000
SHALL BE WITHHELD AND CREDITED TO STATE LOTTERY REVENUES FROM:
(1) THE TOTAL TO BE DISTRIBUTED TO THE SUBDIVISIONS PURSUANT TO
SUBSECTION (C) FOR THE FINAL 3 MONTH PERIOD OF "LOTTO" GAME
OPERATIONS DURING FISCAL YEAR 1984; OR (2) FROM FUNDS DUE TO THE
SUBDIVISIONS, IN PROPORTION TO THEIR RESPECTIVE SHARES OF "LOTTO"
PROCEEDS AS DETERMINED FOR THAT FINAL 3 MONTH PERIOD, UNDER
APPLICABLE PROVISIONS OF STATE LAW RELATING TO THE INCOME TAX,
THE TAX ON RACING, THE RECORDATION TAX, THE TAX ON AMUSEMENTS,
AND THE LICENSE TAX. (E) THE PROVISIONS OF SUBSECTION (A) OF THIS SECTION SHALL
AUTOMATICALLY TERMINATE AND BE OF NO FURTHER FORCE AND EFFECT 1
YEAR AFTER THE BEGINNING OF THE FIRST 3 MONTH PERIOD FOR WHICH A
DISTRIBUTION IS MADE TO THE POLITICAL SUBDIVISIONS. THE
PROVISIONS OF SUBSECTIONS (C) AND (D) OF THIS SECTION SHALL
TERMINATE 60 DAYS AFTER NOTICE BY THE STATE COMPTROLLER TO THE
STATE LOTTERY AGENCY THAT ALL THE ADJUSTMENTS PROVIDED FOR BY
THOSE SUBSECTIONS HAVE BEEN COMPLETED. SECTION 2. AND BE IT FURTHER ENACTED, That political
subdivisions may accrue as revenues for the 1984 fiscal year any
distributions authorized pursuant to this Act.
SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1983. Approved May 24, 1983.
CHAPTER 395 (Senate Bill 629) AN ACT concerning Local Government Powers - Planning and Zoning FOR the purpose of specifying that it is the policy of the
General Assembly and of this State that free business
enterprise and economic competition be displaced or limited
by the planning and zoning controls implemented by local
government; generally relating to local government powers in
regard to planning and zoning; and making provisions of this
Act severable.
