Commissioners of Frederick, Garrett, and Washington counties
by means of cloud seeding or otherwise or by use of ground
generators unless the person complies with certain federal laws and rules or regulations; providing for certain penalties; and providing for the automatic expiration of
this Act on a certain date to license persons who engage in
weather modification and require the reporting of weather
modification activities. BY adding to Article - Health - Environmental Section 2 609.1 Annotated Code of Maryland (1982 Volume) Article 25 - County Commissioners Section 3(mm) Annotated Code of Maryland (1981 Replacement Volume and 1982 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article Health - Environmental 25 - County Commissioners 2-609.1 (A) UNLESS THE PERSON COMPLIES WITH EVERY APPLICABLE FEDERAL LAW AND RULE OR REGULATION OF THE NATIONAL OCEANIC AND
ATMOSPHERIC ADMINISTRATION, A PERSON MAY NOT PERFORM ANY OF THE
FOLLOWING ACTS IN OR OVER ANY PART OF ALLEGANY, FREDERICK,
GARRETT, AND WASHINGTON COUNTIES: (1) ENGAGE IN ANY CLOUD SEEDING OR OTHER ARTIFICIAL
FORM OF WEATHER MODIFICATION; OR (2) USE ANY GROUND GENERATOR FOR THE PURPOSES OF
WEATHER MODIFICATION. (B) A PERSON WHO VIOLATES ANY PROVISION OF THIS SECTION
GUILTY OF A MISDEMEANOR AND, ON CONVICTION, IS SUBJECT TO A FINE
NOT EXCEEDING $50,000 OR IMPRISONMENT NOT EXCEEDING 5 YEARS OR
BOTH.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983. It shall remain in effect for a period
of 2 years and, at the end of June 1985, with no further action
required by the General Assembly, this Act shall be abrogated and
of no further force and effect and shall be removed from the
Annotated Code of Maryland.
