(Senate Bill 350)
AN ACT concerning
Workmen's Compensation - Real Estate
Salespersons and Brokers
FOR the purpose of providing that certain real estate
salespersons and brokers are not employees for purposes of
the workmen's compensation law.
BY adding to
Article 101 - Workmen's Compensation
Section 21(c)(7)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 101 - Workmen's Compensation
21.
(c) The following employees are exempt from the coverage of
this act:
(7) ANY PERSON WHO IS A LICENSED REAL ESTATE
SALESPERSON OR AN ASSOCIATE REAL ESTATE BROKER, AFFILIATED WITH A
LICENSED REAL ESTATE BROKER, UNDER A WRITTEN AGREEMENT,
REMUNERATED ON A COMMISSION ONLY BASIS, AND WHO QUALIFIES AS AN
INDEPENDENT CONTRACTOR FOR FEDERAL TAX PURPOSES.
