(b) A person may not catch oysters by dredge except in the
following waters: (4)  Talbot County. The waters lying between a line
drawn from [Lows] LOWES Point to Bloody Point Lighthouse and a
line drawn from Wades Point Farmhouse to Wades Point bell buoy
and then from Wades Point bell buoy to Second Kent or Long Point. 4-1203. If amy Natural Resources Police officer or any law
enforcement officer has probable cause to believe that any person
possesses any fish or any device in violation of this title, the
officer shall go before any District Court judge of the county in
which the fish or device is supposed to be and make affidavit to
that fact. If the judge finds the affidavit legally sufficient,
he shall issue a search warrant against the person complained of,
directed to the officer making the affidavit, commanding him to
proceed at once and search for the fish or device and, upon
finding it, to seize, take possession, and keep it until further
order by the judge. The warrant shall be executed pursuant to
Rule [707] 780 of the Maryland Rules of Procedure or Rule [707]
780 of the Maryland District Rules. The warrant shall be returned
within five days from the issuing date or within a shorter period
of time as set forth in the search warrant. 5-608. (b) Each person to whom this subtitle applies shall: (5)  Provide for leases and timber cutting rights. The
provisions of this subtitle and any rule or regulation
promulgated under it apply to the owner of the land or stumpage,
and to any person whose operation is in timber, trees, or wood
held under a lease or cutting rights on June 1, 1943. However,
due consideration shall be given to ownership equities existing
on June 1, 1943, in order to avoid causing unreasonable hardship.
Any lease or cutting right entered into after June 1, 1943, is
unreservedly subject thereto. Any owner or operator on his own
forest property or property leased to him, may develop and
inaugurates his own alternate plan of management and employ
standards and methods to accomplish the purpose of this subtitle,
as specified in paragraphs (2), (3), and (4) of this [section]
SUBSECTION, provided the plan is submitted on forms the
Department furnishes to the board having jurisdiction and the
board accepts the plan as one which gives reasonable assurance of
accomplishing the purposes of this subtitle. In arriving at its
decision, the board shall consider, among other factors, economic
conditions of the area in which the land is situated, the
valuation and rates for tax purposes, and social and economic
effects of the proposed alternate plan. A landowner may present
working plans for cutting and management of his forest to the
board for approval. These plans shall be for the period
prescribed by the Department. The Department shall furnish the
necessary forms. Free advice and assistance of the Department is
available to forest owners as far as possible; and
