"AFFILIATE" MEANS:

(1)  EACH PARTNER OF A PARTNERSHIP;

(2)  EACH OFFICER, DIRECTOR, AND STOCKHOLDER WHO
HAS DIRECT OR INDIRECT OWNERSHIP OR CONTROL OF 10 PERCENT OR
MORE OF THE STOCK OF A CORPORATION; OR

(3)  EACH INDIVIDUAL WHO HAS DIRECT OR INDIRECT
OWNERSHIP OF 10 PERCENT OR MORE OF A NURSING HOME.

(C) NURSING HOME.

"NURSING HOME" MEANS A RELATED INSTITUTION THAT IS
CLASSIFIED AS A NURSING HOME.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 43, § 560B(a) and
(a)(1) and (5).

Former Article 43, § 560B(a)(2), which defined
"court" to specify courts in Baltimore City and
the circuit court for any other county, is
deleted as unnecessary in light of the
reorganization of the Baltimore City courts.

Former Article 43, § 560B(a)(3), which defined
"Director", is deleted as unnecessary since the
full title "Director on Aging" is used in Part V
of this subtitle.

Former Article 43, § 560B(a)(6), which defined
"Secretary", is deleted as unnecessary in light
of the definition of that term in § 1-101 of this
article.

Former Article 43, § 560B(a)(7), which defined
"transfer trauma", is deleted as unnecessary
since that phrase did not appear in former
Article 43, § 560B.

Defined term: "Related institution" § 19-301

19-334. PETITIONS FOR RECEIVERSHIP.

(A) AUTHORIZED.

IN ADDITION TO ANY OTHER POWER SET FORTH IN THIS
ARTICLE OR THE HEALTH OCCUPATIONS ARTICLE, THE SECRETARY MAY
FILE A PETITION FOR APPOINTMENT OF A RECEIVER FOR A NURSING
HOME IF, AFTER INVESTIGATION OF THE SECRETARY OR AFTER
INVESTIGATION AT THE REQUEST OF THE DIRECTOR ON AGING, THE
SECRETARY REASONABLY BELIEVES THAT:
