The former reference "establish" is deleted as
inaccurate since, under § 19-311 of this
subtitle, approval rather than a "license" is
required to establish a hospital or related
institution.

The former references "conduct" and "maintain"
are deleted as unnecessary in light of the broad
word "operate".

19-319. QUALIFICATIONS FOR LICENSES.

(A)   IN GENERAL.

TO QUALIFY FOR A LICENSE, AN APPLICANT AND THE HOSPITAL
OR RELATED INSTITUTION TO BE OPERATED SHALL MEET THE
REQUIREMENTS OF THIS SECTION.

(B)  APPLICANT.

AN APPLICANT WHO IS AN INDIVIDUAL, AND ANY INDIVIDUAL
WHO IS APPLYING ON BEHALF OF A CORPORATION, ASSOCIATION, OR
GOVERNMENT AGENCY SHALL BE:

(1)  AT LEAST IS YEARS OLD; AND

(2)  OF REPUTABLE AND RESPONSIBLE CHARACTER.

(C)  HOSPITAL OR RELATED INSTITUTION.

(1)  THE APPLICANT SHALL HAVE A CERTIFICATE OF
NEED, AS REQUIRED UNDER SUBTITLE 1 OF THIS TITLE, FOR THE
HOSPITAL OR RELATED INSTITUTION TO BE OPERATED.

(2)  THE HOSPITAL OR RELATED INSTITUTION TO BE
OPERATED SHALL MEET THE REQUIREMENTS THAT THE SECRETARY
ADOPTS UNDER THIS SUBTITLE.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to state affirmatively that the
applicant and the proposed hospital or related
institution must meet these qualifications.

Subsections (b) and (c) of this section are new
language derived without substantive change from
former Article 43, § 559(a-1) and the third
clause of the first sentence of (a) and the first
sentence of § 560(a).
