19-311. APPROVAL REQUIRED.

A PERSON SHALL HAVE THE APPROVAL OF THE SECRETARY
BEFORE THE PERSON MAY:

(1)  BUILD A HOSPITAL OR RELATED INSTITUTION; OR

(2)  MAKE ANY CONVERSION, ALTERATION, OR ADDITION
TO THE PLANT OR BUILDING THAT WILL AFFECT THE FUNCTIONAL
STRUCTURE OR NORMAL BED CAPACITY OF A HOSPITAL OR RELATED
INSTITUTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 43, § 561(b).

Former Article 43, § 565B, which required
approval for construction of or changes in a
hospital used as a related institution and
authorized adoption of standards and inspections,
is deleted as unnecessary in light of the
requirements of Part II of this subtitle,
including the requirement for approval of "any
conversion", and § 19-308 of this subtitle, as to
standards. The Department also indicates that
this former section is not used.
