LAWS OF MARYLAND

Ch. 21

RECOMMENDATIONS MADE UNDER SUBTITLE 1 OF THIS TITLE, ON
COMPREHENSIVE HEALTH PLANNING.

(F) CERTAIN RATES TO BE PERMITTED.

IN REVIEWING RATES OR CHARGES OR CONSIDERING A REQUEST
FOR CHANGE IN RATES OR CHARGES, THE COMMISSION SHALL PERMIT
A FACILITY TO CHARGE RATES THAT, IN THE AGGREGATE, WILL
PRODUCE ENOUGH TOTAL REVENUE TO ENABLE THE FACILITY TO MEET
REASONABLY EACH REQUIREMENT SPECIFIED IN THIS SECTION.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 568V.

In subsection (a)(1) of this section, the former
reference to beginning compilation
"{i} immediately upon the effective date of this
subtitle" is deleted to reflect that compiling
this information is a continuing duty of the
Commission.

In subsection (a)(2)(iii) of this section, the
former reference to interest charges as
"properly" incurred is deleted as unnecessary.

In subsection (c) of this section, the word
"change" is substituted for "amendments or
modifications"-, to conform to the references in
subsections (b) and (f) of this section.

In subsection (d)(2)(ii) of this section, the
singular "owner" is substituted for the plural
"owners", to reflect that there may be a single
individual, corporate, or other "owner".

The introductory phrase of former Article 43, §
568V, which indicated that the Commission has the
powers under this section "{t}o properly carry
out its authority", is deleted as unnecessary.

The only other changes are in style.

Defined terms: "Commission" § 19-201
"Facility" § 19-201
"Includes"/"including" § 1-101

19-218. ACCOUNTING PRINCIPLES FOR RATE DETERMINATIONS.

THE COMMISSION SHALL USE ANY REASONABLE, RELEVANT, OR
GENERALLY ACCEPTED ACCOUNTING PRINCIPLES TO DETERMINE
REASONABLE RATES FOR EACH FACILITY.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 568VA.
