HARRY HUGHES, Governor

845

In subsection (b)(2) of this section, the phrase
"gonorrhea or syphilis" is substituted for the
phrase "gonorrhea and syphilis", for clarity.

In subsection (c) of this section, the former
statement that a laboratory examination is "an
essential aid to diagnosis", but not "a final
diagnosis", is deleted as unnecessary in light of
the requirement that a physician report under §
18-201 of this subtitle.

In subsection (g) of this section, the former
phrase "subject to the provisions of this
section" is deleted as unnecessary.

Subsection _ (h) of this section is derived from
the second sentence of former Article 43, §
31A(d). The Attorney General had advised the
Governor that the sentence could not be given
effect since the title of SB 223, which amended
Article 43, § 31A(d), inter alia, to add that
sentence, did not reflect that sentence; see Bill
Review Letter (S.B. 223) from Stephen H. Sachs,
Attorney General, to Harry R. Hughes, Governor,
May 1, 1980. Subsection (h) of this section
gives effect to that former sentence in
accordance with the apparent intent of the
General Assembly.

Former Article 43, § 31A(a)(l), which was
standard introductory language to a definition
provision, is deleted as unnecessary.

Former Article 43, § 31A(a)(2) and (4), which
defined "health officer" and "Secretary", is
deleted as unnecessary in light of the definition
of those terms in § 1-101 of this article.

Former Article 43, § 31A(a)(3), which defined
"laboratory", is deleted as unnecessary.

Defined terms: "Department" § 1-101

"Health officer" § 1-101 "Physician" § 1-101

"Includes"/"including" § 1-101

"Person" § 1-101 "Secretary" § 1-101

18-206. RESERVED.

18-207. RESERVED.

PART II. CONTROL OF INFECTIOUS AND CONTAGIOUS DISEASES.

18-208. GENERAL DUTIES.
