HARRY HUGHES, Governor

837

PART I. REPORTS ON DISEASES.

18-201. INFECTIOUS OR CONTAGIOUS DISEASE REPORTS -- BY
PHYSICIANS.

(A)  REPORT REQUIRED.

A PHYSICIAN WITH REASON TO SUSPECT THAT A PATIENT UNDER
THE PHYSICIAN'S CARE HAS AN INFECTIOUS OR CONTAGIOUS DISEASE
THAT ENDANGERS PUBLIC HEALTH SHALL SUBMIT IMMEDIATELY A
REPORT TO THE HEALTH OFFICER FOR THE COUNTY WHERE THE
PATIENT RESIDES PHYSICIAN CARES FOR THAT PATIENT.

(B)  FORM AND CONTENTS.
THE REPORT SHALL:

(1)  BE ON THE FORM THAT THE SECRETARY PROVIDES;

(2)  IDENTIFY THE DISEASE OR SUSPECTED DISEASE;

(3)  STATE THE NAME, AGE, RACE, SEX, AND
RESIDENCE ADDRESS OF THE PATIENT; AND

(4)  BE SIGNED BY THE PHYSICIAN.

REVISOR'S NOTE: Subsections (a) and (b)(2), (3), and
(4) of this section are new language derived
without substantive change from the first clause
of former Article 43, § 78.

Subsection (b)(1) of this section is new language
derived from the third sentence of former Article
43, § 79 and the fifth sentence of § SO, which

required the Secretary to provide to health
officers the forms needed for this section. It
is revised to reflect the apparent intent of
those sentences and to conform to Department
practice.

Throughout this section, the word "report" is
substituted for the word "notice", to conform to
Department practice.

In subsection (a) of this section, the phrase
"where the physician cares for that patient" is
substituted for the ambiguous phrase "in which
such disease exists", to conform to Department
practice.

Also in subsection (a) of this section, the
former reference "knows or has reason to believe"
is deleted as unnecessary in light of the
inclusive word "suspect".
