REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
101, § 30.

This section is revised to clarify that the
Secretary and the Baltimore City Commissioner of
Health have parallel, but independent, authority
as to occupational diseases in Baltimore City.
The first paragraph of former Article 101, § 30
referred ambiguously to "the duty of the
{Secretary} and of the commissioner of health
of Baltimore City, concurrently", which could be
read to require joint action or to state
concurrent jurisdiction.

This section also is revised to clarify that the
Baltimore City Commissioner of Health has
authority only in that city.

Throughout this section, the defined term
"Secretary" is substituted for the obsolete
references to the former "State Department of
Health" and "State Board of Health".

The second sentence of former Article 101, §
30(2), which provided that the rules and
regulations have the effect of law, is deleted as
unnecessary.

18-107. DISEASES OF PREGNANCY AND CHILDHOOD.

(A) DUTY OF THE SECRETARY.

THE SECRETARY SHALL:

(1) DEVISE AND INSTITUTE MEANS TO PREVENT AND
CONTROL:

{I) INFANT MORTALITY;

(II)  DISEASES OF PREGNANCY;

(III)  DISEASES OF CHILDBIRTH;

(IV)  DISEASES OF INFANCY; AND

(V)  DISEASES OF EARLY CHILDHOOD; AND

(2)

AND INFANCY.

PROMOTE THE WELFARE AND HYGIENE OF MATERNITY
