(2) TO REPRESENT OR SERVICE IN THIS STATE A
TISSUE BANK THAT IS OUTSIDE THIS STATE.
REVISOR'S MOTE: This subsection is new language added
to allow concise reference to a permit issued
under this subtitle.
Former Article 43, § 34(a) specifically referred
to a "permit", in connection with operating a
tissue bank. As to representing or servicing a
tissue bank, however, former Article 43, § 34(a)
referred only to "appropriate annual
application". This subtitle is revised to
clarify that application is made for a permit.

(C) TISSUE BANK.
(1) "TISSUE BANK" MEANS AN ESTABLISHMENT THAT
OBTAINS, STORES, PROCESSES, DISTRIBUTES, OR SELLS HUMAN
BLOOD OR OTHER HUMAN TISSUE FOR USE IN THE HUMAN BODY.
(2) "TISSUE BANK" INCLUDES A BLOOD BANK.
REVISOR'S NOTE: Paragraph (1) of this subsection is new
language derived without substantive change from
the third clause of the first sentence, the third
clause of the eighth sentence, and the second
clause of the ninth sentence of former Article
43, § 34(a). It is revised as a definition to
allow concise reference to the tissue banks
governed by this subtitle.
Paragraph (2) of this subsection formerly
appeared as the first clause of the ninth
sentence of Article 43, § 34(a).
Former Article 43, § 34(a) referred to
"laboratories and tissue banks ... which make
examinations in connection with the diagnosis and
control of human {diseases} which procure,
process, distribute, or sell human tissue".
These former provisions, as to tissue banks, are
revised in this subtitle. These former
provisions, as to medical laboratories, are
revised in Subtitle 2 of this title. As part of
this revision, the terms "medical laboratory" and
"tissue bank" are defined separately and clarify
that medical laboratories make examinations and
that tissue banks deal in tissue.
