REVISOR'S NOTE: This section is new language patterned
after the fourth sentence of Article 43, §
35(a)(2), as that sentence relates to billing and
collecting fees.

The provisions of the fourth sentence of Article
43, § 35(a)(2) that relate to setting fees now
appear in § 17-103.

16-208. UNIFORMITY OF ENFORCEMENT.

AS FAR AS PRACTICAL, THE RULES AND REGULATIONS
ENFORCING THIS SUBTITLE SHALL BE APPLIED UNIFORMLY TO ALL
INDIVIDUALS WHO RECEIVE SERVICES UNDER PROGRAMS THAT EITHER
ARE OPERATED BY THE DEPARTMENT OR SUPPORTED WHOLLY OR PARTLY
BY STATE OR FEDERAL FUNDS ADMINISTERED BY THE DEPARTMENT.

without substantive change from former Article
43, § 601(e).

SUBTITLE 3. SPECIAL PROVISIONS AS TO MENTAL HYGIENE.

16-301. APPLICABILITY OF SUBTITLE 2.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, SUBTITLE
2 OF THIS TITLE APPLIES TO A RECIPIENT OF SERVICES UNDER THE
MARYLAND MENTAL HYGIENE LAW.

REVISOR'S NOTE:: This section is new language added to
clarify the general applicability of Subtitle 2
of this title to mental health services provided
in outpatient, inpatient, and other facilities
under Title 10 of this article.

It is based essentially on former Article 59, §
39(b), which incorporated by reference the
various provisions of former Article 43, § 601
that now appear in Subtitle 2 of this title. In
light of this section and the revision of
Subtitle 2 of this title, the former specific
references in Article 59, § 39(b) are deleted as
superfluous.

As to the applicability of various definitions
appearing in Title 10 of this article, see §
16-101 of this title.
