15-118. DRUGS.

(A)  FORM FOR PRESCRIBING DRUGS.

THE FORM THAT IS USED IN PRESCRIBING DRUGS UNDER THE
PROGRAM SHALL INCLUDE THE FOLLOWING STATEMENT: THIS
PRESCRIPTION SHALL BE FILLED WITH A GENERIC EQUIVALENT FROM
THE FORMULARY OF THE DEPARTMENT, UNLESS THE PRESCRIBING
PHYSICIAN DIRECTS OTHERWISE IN WRITING.

(B)  USE OF GENERIC DRUGS.

UNLESS THE PRESCRIBER DIRECTS OTHERWISE ON THE FORM OR
ON AN ATTACHED SIGNED CERTIFICATION OF NEED, THE GENERIC
FORM OF THE DRUG FROM THE DEPARTMENT FORMULARY OR THE LIST
OF MULTIPLE SOURCE DRUGS AS FINALLY DETERMINED AND PUBLISHED
BY THE PHARMACEUTICAL REIMBURSEMENT BOARD IN THE UNITED
STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES SHALL BE USED
TO FILL THE PRESCRIPTION.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 42(a)(4) and (5).

The reference to the "United States Department of
Health and Human Services" is substituted for the
obsolete reference to the "United States
Department of Health, Education, and Welfare", to
conform to current nomenclature.'

15-119. IMPLEMENTATION IN BALTIMORE CITY.

FOR THE PURPOSES OF §§ 15-103, 15-104, AND 15-106 OF
THIS TITLE AS THEY APPLY TO BALTIMORE CITY, THE BALTIMORE
CITY COMMISSIONER OF HEALTH MAY APPOINT THE NECESSARY
INDIVIDUALS TO CARRY OUT THE PURPOSES OF THOSE SECTIONS
WITHIN THE BUDGET AND IN ACCORDANCE WITH THE BALTIMORE CITY
CHARTER.
