15-104. CONTRACTS WITH DEPARTMENT OF HUMAN RESOURCES.

THE SECRETARY MAY CONTRACT WITH THE DEPARTMENT OF HUMAN
RESOURCES TO PROVIDE MEDICAL SERVICES TO THOSE INDIVIDUALS
FOR WHOM:

(1)  FUNDS ARE APPROPRIATED TO THE DEPARTMENT OF
HUMAN RESOURCES; AND

(2)  THE DEPARTMENT OF HUMAN RESOURCES IS
RESPONSIBLE UNDER THE APPROPRIATION.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 42(e).

The defined term "Secretary" is substituted for
the reference to the former State Department of
Health. See the General Revisor's Note to this
article.

The term "Department of Human Resources" is
substituted for the obsolete references to the
former Department of Public Welfare.

The only other changes are in style.

15-105. REIMBURSEMENT PROCEDURES UNDER PROGRAM.

(A)  RULES AND REGULATIONS; TIME LIMITATION.

THE DEPARTMENT SHALL ADOPT RULES AND REGULATIONS FOR
THE REIMBURSEMENT OF PROVIDERS UNDER THE PROGRAM. HOWEVER,
EXCEPT FOR AN INVOICE THAT MUST BE SUBMITTED TO A MEDICARE
INTERMEDIARY OR MEDICARE CARRIER FOR AN INDIVIDUAL WHO MAY
HAVE BOTH MEDICARE AND MEDICAID COVERAGE, PAYMENT MAY NOT BE
MADE FOR AN INVOICE THAT IS RECEIVED MORE THAN 1 YEAR AFTER
THE DATES OF THE SERVICES GIVEN.

(B)  LATE INVOICES.

A PROVIDER WHO FAILS TO SUBMIT AN INVOICE WITHIN THE
REQUIRED TIME MAY NOT RECOVER THE AMOUNT LATER FROM THE
PROGRAM RECIPIENT.
