14-113. PROHIBITED ACTS.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, A PERSON
MAY NOT OPERATE A GROUP DAY CARE CENTER IN THIS STATE UNLESS
LICENSED BY A HEALTH OFFICER.

14-114. PENALTIES.

(A)   IN GENERAL.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE OR
ANY RULE OR REGULATION ADOPTED UNDER IT IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $500 FOR THE FIRST OFFENSE AND NOT EXCEEDING
$1,000 FOR ANY SUBSEQUENT OFFENSE.

(B)  SEPARATE OFFENSES.

EACH DAY THAT A GROUP DAY CARE CENTER OPERATES
ILLEGALLY AFTER A FIRST CONVICTION IS A SEPARATE OFFENSE.

NOTE: This section formerly appeared as
Article 43, § 716.

The former phrase "maintains and operates a group
day-care center without a license" is deleted as
superfluous.

The only other changes are in style.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that it is unclear whether the severe daily
penalty was intended to apply to any violation of
a group day care center that "operates illegally"
or only to the more serious offense of operating
without a license.
