General Assembly, that there is no express
provision authorizing the establishment of a
license fee. Notwithstanding the absence of this
provision, in the home rule counties only, a
license fee is charged.

14-107. ISSUANCE OF LICENSE.

A HEALTH OFFICER SHALL ISSUE A LICENSE TO ANY APPLICANT
WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE AND OF THE RULES
AND REGULATIONS ADOPTED UNDER IT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 43, § 711.

The former reference to a license "to establish,
maintain, and operate" is deleted as unnecessary
in light of the use of the defined term
"license".

14-108. SCOPE OF LICENSE; CHANGES.

(A)   IN GENERAL.

A LICENSE AUTHORIZES THE LICENSEE TO OPERATE A GROUP
DAY CARE CENTER WHILE THE LICENSE IS EFFECTIVE.

(B)  CHANGES IN BUILDING, PLANTS, AND FACILITIES.

UNLESS A HEALTH OFFICER FIRST APPROVES THE CHANGE, A
LICENSEE MAY NOT MAKE ANY SUBSTANTIAL ADDITION TO OR OTHER
CHANGE IN A BUILDING OR PLANT OF THE GROUP DAY CARE CENTER
OR A CHANGE IN ITS FACILITIES THAT COULD AFFECT MATERIALLY
ANY CONDITION UNDER WHICH THE LICENSE WAS ISSUED.

REVISOR'S NOTE: Subsection (a) of this section is a
standard provision added for clarity.

Subsection (b) of this section is new language
derived without substantive change from former
Article 43, § 714.
