land of the State reserved for tongers exclusively or closed
by any rule or regulation, or order of the Department. The
taking of oysters by scoop, dredge or handscrape by hand may
be authorized by the Secretary upon the recommendations of
the appropriate county tongers committee, in areas reserved
for tonging when areas which are designated for tonging
oysters are closed because of icing conditions at least 7
consecutive days. Handscraping may be authorized on a day
for working day basis according to the number of days when
tonging is not possible because of ice cover, but not to
exceed 14 working days. The Secretary may specify areas to
be opened and restrictions on gear. There shall be a limit
of 10 bushels per man and no more than 30 bushels per boat.
A person may not handscrape for oysters after 12 noon.
However, this subsection does not apply to catching seed
oysters under the surveillance and With the permission of
the Department.

7-312.

All first-class mine foremen and fire-boss certificate
holders shall be subject to continuing education every 3
years. The continuing education shall emphasize mine health
and safety legislation and regulations, advances in mining
technology, and advances in first aid that have occurred
since the certificate holder's most recent examination. All
first-class mine foremen and fire-boss certificates issued
prior to July 1, 1980 shall expire no later than July 1,
1983 unless reissued in accordance with this section.

10-418.

(b) The Secretary may grant certificates to any
properly accredited person 14 years of age or older to take
alive, train, and fly falcons, hawks, or owls. To obtain
this certificate an applicant shall pay a $5 fee. [The
certificate shall expire on June 30 of the issuing year. It
may not be transferred to another person, and the Secretary
may revoke it for cause at any time. A person may not
possess more than two of the enumerated birds in any
combination at any one time. In addition, a person may not
sell or offer for sale any falcons, hawks, or owls.] The
birds enumerated in this section shall be used for hunting
game birds or mammals only during open season.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Code of Public Local Laws of Maryland read(s) as
follows:
