SUBTITLE 11. SHORT TITLE.

10-1101. SHORT TITLE.

THIS TITLE MAY BE CITED AS THE "MARYLAND MENTAL HYGIENE
LAW".

REVISOR'S NOTE: This section formerly appeared as

Article 59, § 1.

The word "Maryland" is added for clarity.

Former Article 43, §§ 1J and 44 are revised in
this title and are covered by the short title,
which formerly applied only to Article 59.

Former Article 59, §§ 23 through 28, which
related to issues of competency and insanity in
criminal cases, now appear in Title 12 of this
article and, thus, no longer are covered by the
short title. As to this reorganization, note
that, in addition to any "mental disorder",
"mental retardation" may be an element in a
finding of incompetency or insanity.

Former Article 59, §§ 3(c) and (k), 39, 45, 46,
and 47, which related to financing of services
for individuals with a mental disorder, now
appear in Title 16 of this article and, thus, no
longer are covered by this short title.

The only other changes are in style.

GENERAL REVISOR'S NOTE:

Former Article 59, § 6, which provided for adoption of
rules and regulations for this title, is deleted as
unnecessary in light of § 2-104(b) of this article.

Former Article 59, §§ 53 through 57, which provided for
the Mental Health Information and Review Service, are
deleted because those former sections have not been
implemented since enactment in 1971 because of possible
constitutional problems under the separation of powers
doctrine.
