In subsection (a) of this section, the former
reference to a facility "licensed by or under the
jurisdiction of the Department" is deleted as
unnecessary in light of the use of the defined
term "facility".

Subsection (b)(2) of this section is revised to
clarify that, in practice, the geriatric
evaluation team informs the applicant that
admission is unnecessary and helps the applicant
find the alternative care or treatment that may
be appropriate.

Former Article 59, § 12(a)(2)(i) and the first
sentence of (ii), which" required geriatric
evaluations, is deleted as unnecessary in light
of § 10-603 of this subtitle and subsection
(b)(1) of this section.

Former Article 59, § 12(a)(2)(v), which indicated
that the provisions of § 12(a) are ancillary, is
deleted as unnecessary.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that subsection (a)(4) of this section does not
require consideration of the safety and welfare
of any individual other than the individual for
whom admission is sought.
