without substantive change from former Article
59, § 11(b)(1) and (2)(iii), the first sentence
of (a), the first and second sentences of (c),
the first and second sentences of (d), and the
second clause of the sixth sentence of (g).

Subsection (d)(2) of this section is revised to
clarify that, in practice, the geriatric
evaluation team informs the individual that
admission is unnecessary and helps the individual
to find the appropriate, less restrictive care or
treatment that may be needed.

Former Article 59, § 11(b)(2)(i) and (ii), which
set forth the findings that the geriatric
evaluation team must make, are deleted as
unnecessary in light of subsection (d)(1) of this
section.

The seventh sentence of former Article 59, §
11(g), which stated that former Article 43, §
135A applied to admissions, is deleted as
unnecessary. Former Article 43, § 135A now
appears as § 20-104 of this article.

As to release of an individual admitted under a
formal application or the leaving by the
individual admitted on an informal request, see §
10-803 of this title.

10-610. APPLICATION BY PARENT OR GUARDIAN.

(A) APPLICANT.

ON BEHALF OF A MINOR, A PARENT OR GUARDIAN OF THE
PERSON OF THE MINOR MAY APPLY, UNDER THIS SECTION, FOR
ADMISSION OF THE MINOR TO:

(1)  ANY FACILITY THAT IS NOT A STATE FACILITY;
OR

(2)  THE FOLLOWING STATE FACILITIES:

(I)  A REGIONAL INSTITUTE FOR CHILDREN AND
ADOLESCENTS; AND

(II)  THE CHILD OR ADOLESCENT UNIT OF A

STATE FACILITY.

(B) APPLICATION.
