Former Article 59, § 64(b), which provided that
the file on the 'application and investigation
"shall be open ... until the hearing is
concluded" is deleted as misleading, since it
suggests that after the hearing, the file is
confidential. To the extent that former Article
59, § 64(b) was intended to ensure public access,
it is unnecessary in light of Article 76A, § 3 of
the Code, which generally provides for access to
public records, and subsection (d) of this
section.

The first sentence of former Article 59, § 64(c),
which required the Secretary to adopt rules and
regulations for the public hearing, is deleted as
unnecessary in light of § 10-516 of this
subtitle.

As to the definition of "newspaper" for purposes
of publication of notices, see Article 76, § 8 of
the Code.

10-521. ISSUANCE OF LICENSE.

THE SECRETARY SHALL ISSUE A LICENSE TO ANY APPLICANT
WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 65(7).

Former Article 59, § 65(1) through (6) set out
specific requirements that now appear in § 10-518
of this subtitle as qualifications of applicants
and, therefore, are included under "the
requirements of this subtitle."

TERM AS PROVIDED IN THIS SECTION.

(B) APPLICATION FOR RENEWAL.
