The second sentence of former Article 59, § 60,
which required adoption of the rules and
regulations "in accordance with the terms of the
Administrative Procedure Act", is deleted as
unnecessary, since that Act would apply in any
event.

10-517. LICENSE REQUIRED.

A PERSON SHALL BE LICENSED BY THE SECRETARY BEFORE THE
PERSON MAY ESTABLISH A LARGE PRIVATE GROUP HOME OR SMALL
PRIVATE GROUP HOME.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 63(a) and rephrased in the standard
language used to state affirmatively that a
person must be licensed to establish a private
group home.

The former, erroneous reference to obtaining "an
application for a license" is deleted.

As to the substitution of "large private group
home or small private group home" for the
reference to a "private group home or a large
private group home", see revisor's note to §
10-514(d) and (e) of this subtitle.

10-518. QUALIFICATIONS OF APPLICANTS.

(A) IN GENERAL.

TO QUALIFY FOR A LICENSE, AN APPLICANT SHALL SATISFY
THE SECRETARY THAT THE PROPOSED PRIVATE GROUP HOME:

(1)  IS NEEDED;

(2)  IS COMPATIBLE WITH THE NATURE AND CHARACTER
OF THE AREA INVOLVED;

(3)  IS NOT WITHIN 1,000 FEET OF ANOTHER PRIVATE
GROUP HOME, A JAIL, A DETENTION CENTER, A CORRECTIONAL CAMP,
OR A GROUP HOME FOR SPECIAL POPULATIONS, SUCH AS PAROLEES,
MENTALLY RETARDED INDIVIDUALS, JUVENILES, ALCOHOLICS, OR
DRUG ADDICTS;
