(E) SMALL PRIVATE GROUP HOME.

"SMALL PRIVATE GROUP HOME" MEANS A PRIVATE GROUP HOME
THAT ADMITS AT LEAST 4 BUT NOT MORE THAN 8 INDIVIDUALS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of former Article 59, § 58(b).

The term "private group home" is defined in
subsection (d) of this section as a generic term,
while this definition of "small private group
home" and the definition of "large private group
home" reflect the substantive distinction in the
former phrase "private group home or large
private group home".

"Private group home" § 10-514

REVISOR'S NOTE TO SECTION: Former Article 59, § 58(d),
which defined "Secretary", is deleted as
unnecessary in light of the definition of that
term in § 1-101 of this article.

10-515. LEGISLATIVE POLICY.

IT IS THE POLICY OF THIS STATE THAT:

(1)  AN INDIVIDUAL WHO HAS A MENTAL DISORDER AND
WHO IS PLACED IN A PRIVATE GROUP HOME HAVE, AS FAR AS
POSSIBLE, AN OPPORTUNITY FOR PLACEMENT IN A RESIDENCE IN THE
COMMUNITY OF ORIGIN OF THE INDIVIDUAL; AND

(2)  TO ASSURE, AS FAR AS POSSIBLE, THAT A
COMMUNITY WILL ACCEPT A PRIVATE GROUP HOME, THE PRIVATE
GROUP HOME SHOULD BE LOCATED:

(I)  AFTER CONSULTATION WITH THE LOCAL
GOVERNMENT; AND

(II)   IN A MANNER CONSISTENT WITH THE
PRINCIPLES OF NORMALIZATION AND STATEWIDE STANDARDS.
