10-413. SAME -- MEETINGS; COMPENSATION.

(A)  MEETINGS.

EACH BOARD SHALL MEET AT LEAST 4 TIMES A YEAR, AT THE
TIMES AND PLACES THAT IT DETERMINES.

(B)  COMPENSATION.

A MEMBER OF A BOARD MAY NOT RECEIVE COMPENSATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 32A(d) and the second and fourth clauses of
the second sentence of (e).

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that there is no quorum provision. In the
absence of an express provision, rule, or
regulation, case law indicates that a majority of
the members is a quorum. See Gemeny v. Prince
George's County, 264 Md. 85 (1972); Zeiler v.
Central Ry., 84 Md. 304 (1896); and Heiskell v.
Mayor of Baltimore, 65 Md. 125 (1886).

The Commission also notes that subsection (b) of
this section does not provide for reimbursement
of expenses.

10-414. SAME -- POWERS AND DUTIES.

(A)  POWERS.

EACH BOARD MAY ADOPT RULES AND REGULATIONS FOR THE
CONDUCT OF ITS MEETINGS.

(B)  DUTIES.

(1)  EACH BOARD SERVES IN AN ADVISORY CAPACITY.

(2)  EACH BOARD SHALL:

(I)  SUBMIT TO THE SECRETARY AN ANNUAL
REPORT ON:

1.   THE NEEDS OF INDIVIDUALS WHO HAVE
A MENTAL DISORDER; AND

2.   THE EXTENT TO WHICH ITS STATE
FACILITY MEETS THESE NEEDS;

(II)  ADVISE THE ADMINISTRATIVE HEAD OF THE
