Dear Mr. Speaker:
In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 1518.
This bill prohibits a person in control of certain
premises from giving or allowing to be consumed thereon any
alcoholic beverages other than as specifically permitted or
provided in Article 2B.
Senate Bill 791 contains slightly different wording
which makes it a crime for persons in control of certain
premises in Harford County to knowingly permit the
consumption, possession or transfer of alcoholic beverages
in a manner prohibited by Article 2B.
Though both bills seem to contemplate the same purpose
of prohibiting the consumption of alcohol at regularly
operated business locations open to the general public, the
Attorney General has advised me that both may not be signed
into law because the bills amend the law in different ways
which cannot be reconciled. A copy of the Opinion of the
Attorney General is attached and should be considered as
part of this veto message.
Because the wording in Senate Bill 791 will pose fewer
interpretive problems for those who enforce the law, I have
decided to veto House Bill 1518.
