IS RECEIVING MENTAL HEALTH CARE.
10. 1 INDIVIDUAL WHO IS A RELATIVE
OF A MENTAL HEALTH CARE RECIPIENT.
11. AT LEAST 3 MEMBERS FROM THE
GENERAL PUBLIC.
(2) IF THERE IS MORE THAN ONE STATE FACILITY
WITH A RESIDENTIAL UNIT IN THAT COUNTY, THE REPRESENTATIVE
FROM THESE UNITS SHALL SERVE ON A ROTATING BASIS AND, EXCEPT
FOR BALTIMORE CITY, SHALL BE APPOINTED BY THE DIRECTOR. IN
BALTIMORE CITY, THE BALTIMORE CITY COMMISSIONER OF HEALTH
MAY APPOINT ONE REPRESENTATIVE OF ITS COMMUNITY MENTAL
HEALTH CENTERS.
(B) INTERCOUNTY ADVISORY COMMITTEE.
IF AN INTERCOUNTY ADVISORY COMMITTEE IS ESTABLISHED,
THE GOVERNING BODY OF EACH PARTICIPATING COUNTY SHALL
APPOINT AT LEAST 4 MEMBERS OF THE COMMITTEE.
(C) TENURE OF APPOINTEES; VACANCIES.
(1) THE TERM OF AN APPOINTED MEMBER IS 3 YEARS
AND BEGINS ON JULY 1.
(2) THE TERMS OF ONE THIRD OF THE APPOINTED
MEMBERS OF EACH COUNTY ADVISORY COMMITTEE OR INTERCOUNTY
ADVISORY COMMITTEE END EACH YEAR.
(3) AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.
(4) A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.
(5) A MEMBER WHO SERVES 2 CONSECUTIVE FULL
3-YEAR TERMS MAY NOT BE REAPPOINTED FOR 3 YEARS AFTER
COMPLETION OF THOSE TERMS.
REVISOR'S NOTE: Subsections (a), (b), and (c)(1), (2),
and (5) of this section are new language derived
without substantive change from former Article
43, § 1J(d) and the second clause of the first
sentence and the entire second, third, fourth,
and seventh through tenth sentences of (c)(1).
Subsection (c)(3) of this section is standard
language added to provide for gaps in membership
by indicating that a member serves until a
successor takes office. This is supported by the
cases of Benson v. Mellor, 152 Md. 481 (1927) and
Grooms v. LaVale Zoning Board, 27 Md. App. 266
