TO IMPOSE FRANCHISE FEES, AND TO ESTABLISH RATES, RULES, AND
REGULATIONS FOR FRANCHISE(S) GRANTED UNDER THIS SECTION.

Article 25 - County Commissioners

3C.

(a) The county commissioners of each county in this
State shall have the power to grant to any person [a
franchise] ONE OR MORE FRANCHISES WHICH MAY BE EXCLUSIVE IN
NATURE for a community antenna television system OR OTHER

CABLE TELEVISION SYSTEM, provided that nothing herein

contained NOTHING IN THIS SECTION shall be construed to
authorize or empower the county commissioners of any county
to enact laws or regulations for any incorporated town,
village, or municipality in said county.

(b) The county commissioners may IMPOSE FRANCHISE FEES
AND MAY establish the rates, rules, and regulations for
[those] ANY franchises granted under the provisions of
subsection (a) above.

(B) THE COUNTY COMMISSIONERS MAY GRANT 1 OR MORE
EXCLUSIVE OR NONEXCLUSIVE FRANCHISER) FOR COMMUNITY ANTENNA
SYSTEM(S) OR OTHER CABLE TELEVISION SYSTEM(S) THAT UTILIZES
ANY PUBLIC RIGHT-OF-WAY, HIGHWAY, STREET, ROAD, LANE, ALLEY,
OR BRIDGE, TO IMPOSE FRANCHISE FEES, AND TO ESTABLISH RATES,
RULES, AND REGULATIONS FOR FRANCHISER) GRANTED UNDER THIS
SUBSECTION.

Article 25A - Chartered Counties of Maryland

5.

The following enumerated express powers are granted to
and conferred upon any county or counties which hereafter
form a charter under the provisions of Article 11A of the
Constitution, that is to say:

(B)

To provide for the protection of the county property;
to provide for the acquisition by purchase, lease, or
otherwise, and condemnation of property required for public
purposes in the county; to dispose of any real or leasehold
property belonging to the county, provided the same is no
longer needed for public use; to grant any franchise or
right to use the same, or any right or franchise in relation
to any highway, street, road, lanes, alley or bridge; TO
GRANT ONE OR MORE FRANCHISES, WHICH MAY BE EXCLUSIVE IN
NATURE, FOR A COMMUNITY ANTENNA SYSTEM OR OTHER CABLE
TELEVISION SYSTEM, TO ESTABLISH RATES AND REGULATE SERVICES,
TO IMPOSE FRANCHISES FEES, AND TO ESTABLISH OTHER RULES TO
GOVERN THE OPERATION OF THE FRANCHISES; TO GRANT 1 OR MORE
