AN ACT concerning
Used Oil - Prohibition on Burning
FOR the purpose of prohibiting a person from burning any
used oil unless it is refined re-refined and the
emissions from the burning of used oil meet federal and
State air, quality standards; defining a certain term;
and exempting certain uses of used oil from this Act.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

8-1411.1
(a) In this section, the following words have the
meanings indicated.
(3) "RE-REFINING" MEANS THE USE TECHNIQUES ON
AND PROCESSING OF USED OIL TO REMOVE WATER, LEAD, FLY ASH
PARTICULATES, CHLORINATED ORGANIC MATERIAL, AND OTHER
MATERIALS THAT MAY REPRESENT A HAZARD DURING REUSE SO THAT
THE RE-REFINED OIL IS SUBSTANTIALLY EQUIVALENT IN QUALITY TO
ORIGINAL OIL INTENDED FOR THE SAME PURPOSE AND IS RE-REFINED
BASE OIL. RE-REFINING MAY INCLUDE DISTILLATION AND/OR
TREATMENTS EMPLOYING ACIDS, CAUSTIC SOLVENTS, CLAY AND/OR
OTHER CHEMICALS.
(f) (1) Except as provided under § 8-1413.2 of this
title or any other provisions of law, after January 1, 1979,
