(k) Any participant in an optional retirement program,
established pursuant to this section, who was eligible for
membership in the EMPLOYEES' RETIREMENT SYSTEM, THE PENSION
SYSTEM FOR THE EMPLOYEES OF THE STATE OF MARYLAND, THE

Teachers' Retirement System or the Pension System for the

Teachers of the State of Maryland at the time the

participant elected to participate in the optional

retirement program, and the participant desires to continue
employment after the end of the school year following the
date on which the member attains the age of 70:

(1)  Shall apply, at least 30 days and not more
than 90 days prior to the end of that school year, to the
participant's appointing authority, on a form provided by
the Secretary of Personnel, for continuation of employment
on an annual basis;

(2)  If the written application for continuation
by the participant is approved by the appointing authority,
employment shall be authorized for 1 year. Further
continuation of employment shall be based on the execution
of the appropriate application form within 30 days and not
more than 90 days prior to the completion of each authorized
year; and

(3)  If the written application by the member is
not approved, upon request, the participant shall be given a
full hearing before the Maryland Employees Retirement Review
Board pursuant to § 11(2) of this article.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 479.

This bill allows certain members of the Employees'
Retirement System and the Pension System for employees of
the State of Maryland to participate in the Optional
Retirement Program.

Senate Bill 269, which was passed by the General
Assembly and signed by me on June 1, 1982 accomplishes the
same purpose. Therefore, it is not necessary for me to sign
House Bill 479.
