AN ACT concerning

Outdoor Advertising - Highway Signs

FOR the purpose of prohibiting any county or municipality
from removing or requiring the removal of certain
outdoor advertising signs unless the county or
municipality pays a certain fair market value for the
sign.

BY adding to

Article 25 - County Commissioners

Section 122E

Annotated Code of Maryland

(1981 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 25 - County Commissioners

122E.

UNLESS THE COUNTY OR MUNICIPALITY PAYS THE FAIR MARKET
VALUE OF AN OUTDOOR ADVERTISING SIGN, IN ACCORDANCE WITH THE
JUST COMPENSATION SCHEDULE OF THE STATE DEPARTMENT OF
TRANSPORTATION, A COUNTY OR MUNICIPALITY MAY NOT REMOVE OR
REQUIRE THE REMOVAL OF ANY OFF-PREMISES OUTDOOR ADVERTISING
SIGN THAT WAS LAWFULLY ERECTED UNDER STATE, COUNTY, OR
MUNICIPAL LAW OR ORDINANCE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
