(b) Upon receipt of a petition, the State Board
for Community Colleges shall make a written report to the
Board of Public Works describing the request for financial
assistance and recommending a disposition. Each report of
the State Board for Community Colleges shall contain its
determination of the priority of needs for public junior,
community, or and regional community college facilities
among the counties and the City of Baltimore. The State
Board for Community Colleges also shall submit to the State
Board for Higher Education a copy of each petition and
project proposal.
(c) No grant of financial assistance may be made
until the grant has been approved by the Board of Public
Works and until the Board of Public Works has certified to
the Treasurer and the Comptroller the allocation of State
funds. The Comptroller shall issue a warrant to the
Treasurer to pay the allocated funds to the county or
counties, or the City of Baltimore, when needed for the
design and construction of an approved project and for the
acquisition of property. The decision of the Board of
Public Works shall be in such form as the Board deems proper
and shall be conclusive upon all parties.
(d) The amount of financial assistance granted
under this Act to any county, to the City of Baltimore, or
the counties that support a regional community college, for
any public junior, community, or regional community college
capital project, shall be as follows:
(i) For regional community colleges
established pursuant to § 16-302 of the Education Article,
75 percent of the total construction costs, including site
acquisition and development costs; and
(ii) For public junior or community
colleges that are not regional community colleges, the
greater of:
1. The amount determined by
multiplying the total construction costs, including site
acquisition and development costs, by a percentage equal to
that percentage of the expenditure for basic . current
expenses that the State pays, pursuant to § 5-202(b) of the
Education Article, to that county or the City of Baltimore
in which the public junior or community college is located;
or
2. One-half of the total
construction costs, including site acquisition and
development costs.
