REVISOR'S NOTE: Subsections (a)(1), (2)(i), and (3)(i)
and (iii) and (b) of this section are new
language derived without substantive change from
former Article 43B, § 9(n)(l) and the first
sentence of (2) and the first sentence of §
12(c), as that sentence related to duration of
commitments.
Subsection (a)(2)(ii) of this section is new
language derived without substantive change from
the last clause of former Article 43B, § 5(1) and
the first sentence of § 14(c).
Subsection (a)(3)(ii) of this section is new
language added to reflect that a court may
terminate a commitment. See, e.g., §§
9-648(c)(2), 9-651, and 9-652 of this subtitle.
This section is revised to apply to all
commitments under this subtitle. See revisor's
note to § 9-601 of this subtitle.
The sixth sentence of former Article 43B, §
12(c), which provided a commitment could not
exceed 5 years, is deleted as unnecessary in
light of subsection (a)(3) of this section.

9-647. ASSIGNMENT OR TRANSFERS.
(A) FACILITIES.
THE ADMINISTRATION MAY ASSIGN OR TRANSFER AN INDIVIDUAL
WHO IS COMMITTED TO THE ADMINISTRATION UNDER THIS SUBTITLE
TO A FACILITY OF ANY PERSON OR STATE AGENCY.
(B) SUPERVISION.
(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, THE ADMINISTRATION MAY ASSIGN SUPERVISION OF AN
INDIVIDUAL TO ANY PERSON OR PUBLIC AGENCY, IN ACCORDANCE
WITH THE POLICIES THAT THE ADMINISTRATION ADOPTS AND TO
WHICH THE PERSON OR AGENCY HEAD AGREE.
(2) THE DIVISION OF PAROLE AND PROBATION SHALL
SUPERVISE THE OUTPATIENT CARE OF ANY INMATE WHO IS COMMITTED
UNDER PART V OF THIS SUBTITLE.
