JOINT RESOLUTIONS
WHEREAS, The practice of racial discrimination is
contrary to the democratic principles of this country and an
affront to the laws and people of this State; and
WHEREAS, The United States Supreme Court ruled 20
years ago that racially segregated schools are
unconstitutional, and
WHEREAS, That during the past 3 decades the laws,
policies, and judicial decisions of the United States have
consistently and systematically eliminated the vestiges of
racial discrimination; and
WHEREAS, Through government action, certain
organizations are granted exemption from taxation as
provided under the Internal Revenue Code, Section 501(c)
(3), and this exemption is lawful as applied to legitimate
appropriate organizations that do not discriminate against
individuals because of their race; now, therefore, be it
WHEREAS, Recent federal policy has sanctioned the tax
exempt status of schools that discriminate on the basis of
race; now, therefore, be it
RESOLVED BY THE GENERAL ASSEMBLY OF MARYLAND, That the
Maryland Congressional Delegation is urged to initiate and
support appropriate legislation or resolutions to strengthen
lawful and constitutional nondiscrimination policies
regarding tax exemptions under the Internal Revenue Code;
and be it further
RESOLVED, That the Maryland Congressional Delegation
take the steps necessary to provide that racially segregated
private schools or other organizations that support racial
discrimination, shall continue to be denied the privilege of
exemption from taxation as required under the Constitution,
laws, and judicial holdings pertaining to this issue; and be
it further
RESOLVED, That a copy of this Resolution be sent to the
Maryland Congressional Delegation: Senators Charles McC.
Mathias, Jr. and Paul S. Sarbanes, Senate Office Building,
Washington, D.C. 20510; and Representatives Royden P. Dyson,
Clarence. D. Long, Barbara A. Mikulski, Marjorie S. Holt,
Steny H. Hoyer, Beverly B. Byron, Parren J. Mitchell, and
Michael D. Barnes, House Office Building, Washington, D.C.
20515.
