9-640. ORDER FOR MEDICAL EXAMINATION.

(A)  WITNESSES.

WHEN THE PETITIONER APPEARS BEFORE THE COURT, THE COURT
MAY EXAMINE, UNDER OATH, THE PETITIONER OR ANY OTHER
WITNESSES.

(B)  ORDER FOR EXAMINATION.

(1)  IF THE COURT FINDS THAT THERE ARE REASONABLE
GROUNDS TO BELIEVE THAT THE PETITIONER IS A DRUG ADDICT, THE
COURT SHALL ORDER THE PETITIONER TO HAVE A MEDICAL
EXAMINATION.

(2)  THE ORDER SHALL STATE:

(I)  THE DATE AND FACILITY FOR THE MEDICAL
EXAMINATION; AND

(II)  THE DATE ON WHICH THE PETITIONER IS
TO APPEAR AGAIN BEFORE THE COURT, WHICH DATE SHALL BE,
EXCLUSIVE OF SATURDAYS, SUNDAYS, AND LEGAL HOLIDAYS, WITHIN
7 DAYS AFTER ADMISSION OF THE PETITIONER TO THE MEDICAL
EXAMINATION FACILITY.

(C)  COPIES.

THE PETITIONER AND THE ADMINISTRATION SHALL BE GIVEN A
COPY OF THE ORDER.

REVISOR'S NOTE: This section is new language added to
reflect the substance of former Article 43B, §
9(g)(1) and (3) and the first sentence of (d),
which, by cross-reference, applied to the
proceedings under Part V of this subtitle.
However, the provisions of former Article 43B, §
9(g)(2) and (h), which related to warrants, are
not set out here, as those provisions would not
apply to an inmate. See revisor's note to §
9-601 of this subtitle.

9-641. REPORT ON MEDICAL EXAMINATION.

(A)  REPORT REQUIRED.

AFTER THE MEDICAL EXAMINATION, THE EXAMINERS PROMPTLY
SHALL REPORT TO THE COURT THAT ORDERED THE EXAMINATION.

(B)  PROCEEDING AFTER REPORT.

IF, AFTER REVIEWING THE REPORT, THE COURT IS SATISFIED
