body of wet, swampy or overflowed land,] WATERSHED provided,
however, that no member of the board of drainage viewers
shall be the owner of any land which will be affected by the
proposed improvements. No person appointed as a member of
the board of drainage viewers shall act in that capacity
until he has given the board of county commissioners written
notice of his acceptance of his appointment.

If any member of the board of viewers appointed by any
order of the county commissioners shall die, or remove from
the county or counties in which the [swamp or lowlands are]
WATERSHED IS situated, or otherwise be or become unable to
act, the county commissioners shall appoint another person
in his stead as soon as practicable, and such appointment
shall in no wise affect the validity of any of the work of
the board of viewers theretofore done.

71.

[Said] THE board of managers, when elected or appointed
[as the case may be], [shall be and] is [hereby] constituted
a body corporate under the name and style of "The Board of
Managers of .... [Drainage District,"] PUBLIC DRAINAGE
ASSOCIATION," with the right to hold property and convey the
same, to sue and be sued, to adopt a seal and to alter it at
pleasure, and to exercise corporate powers.

ANY OFFICER OR DIRECTOR OF A PUBLIC DRAINAGE

ASSOCIATION OR PUBLIC WATERSHED ASSOCIATION IS NOT

PERSONALLY LIABLE FOR THEIR ACTIONS AS OFFICERS OR DIRECTORS
OF THEIR RESPECTIVE ASSOCIATIONS.

ANY OFFICER OR DIRECTOR OF A PUBLIC DRAINAGE
ASSOCIATION OR PUBLIC WATERSHED ASSOCIATION, WHILE ACTING IN
A DISCRETIONARY CAPACITY, WITHOUT MALICE, AND WITHIN THE
SCOPE OF THEIR EMPLOYMENT OR AUTHORITY ARE IMMUNE AS
OFFICIALS OR INDIVIDUALS FROM CIVIL LIABILITY FOR ANY ACT OR
OMISSION.

87.

All drainage improvements constructed under this
subtitle shall be under the control and supervision of the
board of managers. It shall be the duty of the [said] board
to keep the [said] drainage improvements in good repair, and
for this purpose. ALSO FOR THIS PURPOSE, they may at any
time levy a drainage tax on the lands benefited in the same
manner and in the same proportion as the original drainage
taxes were levied for the construction of the improvements.
[Such] THE taxes for maintenance purposes shall be levied,
collected and disbursed in the same manner as [hereinbefore]
provided for the original taxes.
