Section 14-111

Annotated Code of Maryland

(1981 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 56 - Licenses

333.

(a)  The Board shall administer and enforce the
provisions of this subtitle.

(b)  The Board shall adopt and promulgate a code of
ethics for the practice of land surveying. A copy of the
Board's code of ethics shall be distributed to every
registrant and applicant for registration under this
subtitle.

(c)  The Board shall adopt and have an official seal,
which shall be affixed to each certificate issued.

(D) THE BOARD SHALL DETERMINE THE TYPE OF STAKE,
MARKER, MONUMENT, OR OTHER LANDMARK TO BE USED BY ANY PERSON
LICENSED TO PRACTICE LAND SURVEYING OR PROPERTY LINE
SURVEYING UNDER THIS SUBTITLE.

[(d)] (E) In enforcing the provisions of this
subtitle, the Board may subpoena witnesses and compel their
attendance and may require the submission of books, papers,
documents, or other pertinent data, in any disciplinary
matter or proceeding where a violation of this subtitle is
alleged.

[(e)] (F) The Board may apply for relief by
injunction, without bond, to enforce this subtitle or to
restrain any violation of it. In the proceedings, it is not
necessary to allege or prove either that an adequate remedy
at law does not exist or that1 substantial or irreparable
damage would not result from the continued violation. A
member of the Board is not personally liable under this
proceeding.

[(f)] (G) The exercise of all powers, authority,
duties, and functions vested in the Board by the provisions
of this subtitle is subject to the authority of the
Secretary of Licensing and Regulation as set forth in the
laws of this State.
