(e) (1) Upon the death of a judge [or former judge] at
any age, his spouse shall be paid one half of the pension
that would be payable from time to time to the [former]
judge if he were living and eligible to receive a pension.
However, the spouse of any judge who dies while in active
service between July 1, 1977 and April 1, 1980 is entitled
to a pension equivalent to not less than one sixth of the
annual salary for judges of that court as of the date of
death.
(2) UPON THE DEATH OF A FORMER JUDGE AT ANY AGE,
THE SURVIVING SPOUSE OF THE FORMER JUDGE SHALL BE PAID
ONE-HALF OF THE PENSION THAT WOULD BE PAYABLE FROM TIME TO
TIME TO THE FORMER JUDGE IF THE FORMER JUDGE WERE LIVING AND
ELIGIBLE TO RECEIVE A PENSION.
(g) If A SPOUSE WHO IS RECEIVING A PENSION DIES, OR IF
a former judge who is receiving a pension dies and leaves no
SURVIVING spouse, or if a SURVIVING spouse who is receiving
a pension dies, payments under either plan shall cease, and
a person may not have any further rights arising from the
judge's service.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
