cases of conflict. Therefore, former Article

9-602. CIVIL NATURE OF PROCEEDINGS.

A DETERMINATION THAT AN INDIVIDUAL IS A DRUG ABUSER AND
A COMMITMENT OF THE INDIVIDUAL UNDER THIS SUBTITLE IS NOT A
CRIMINAL CONVICTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 43B, § 10(a) and
revised to apply to any proceeding under this
subtitle. See revisor's note to § 9-601 of this
subtitle.

The former phrase "drug addict" is deleted as
unnecessary in light of the use of the defined
term "drug abuser".

9-603. COMMITMENT FACILITIES.

§ 9-101

NOTWITHSTANDING ANY OTHER PROVISION OF THIS SUBTITLE, A
COURT MAY NOT COMMIT AN INDIVIDUAL TO THE ADMINISTRATION,
UNTIL THE ADMINISTRATION:

(1) DESIGNATES A FACILITY FOR ADMISSION OF THE
INDIVIDUAL; AND

(2) CERTIFIES THAT THE FACILITY HAS AVAILABLE
SPACE AND ADEQUATE STAFF.
