Also throughout this section, references to the

"administrative head" of a facility are

substituted for references to the director of the

facility, to avoid confusion with references to

the Director of the Administration and to

standardize the references to this type of
position.

Also throughout this section, the references
"after admission ... under this section" are
added to clarify the scope of these provisions.

Subsection (a)(2) of this section is revised to
apply only to a minor, although the reference in
former Article 43B, § 7 -- "if an individual is
under the age of 18 years and unmarried and a
dependent or in the legal custody of his parent,
legal guardian or next of kin" -- could be read
to mean a minor and, whether a minor or an adult,
any other individual in custody. This revision
is based on ET § 13-708(b)(2), which provides
that a disabled person under a guardianship may
not be committed without an involuntary
commitment proceeding. See also § 9-620 of this
title.

In subsection (c)(2) of this section, the
reference to petitioning "for commitment to the
Administration" is substituted for the reference
to a petition "pursuant to § 9 of this article",
for clarity. See revisor's note to § 9-601 of
this title.

As to certification to treat, care for, or
rehabilitate drug abusers, see § 9-403 of this
title.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that the procedures and time limits for approval
of voluntary admission and for treatment, in
practice, do not conform to the provisions of
this section -- i.e., the 30-day and 10-day time
limitations are ignored.
