Ch. 820

pursuant to § 38A of Article 64A, as added by Chapter 255 of
the Acts of 1973. It includes members, of the General
Assembly, judges of the Court of Appeals, the Court of
Special Appeals, the various circuit courts, [the Supreme
Bench of Baltimore,] the District Court, the Maryland Tax
Court, and the various orphans' courts, and part-time and
contractual employees paid through the Central Payroll
Bureau or authorized to be paid through the Central Payroll
Bureau by § 38A of Article 64A. The term "State employees"
also includes the clerks of the courts in all counties and
Baltimore City and all employees in the office of the clerks
of courts; and all registers of wills in all counties and
Baltimore City and all employees in the office of the
register of wills; and all contractual employees of the
State of Maryland, whether or not they are paid through the
Central Payroll Bureau or authorized to be paid through the
Central Payroll Bureau by § 38A of Article 64A. In all cases
of doubt as to whether a person is to be eligible for
participation in the deferred compensation plan, the board
of trustees that administers this plan shall determine
whether any person is a State employee as defined in this
subtitle irrespective or the method of payment.

(g) Any Person aggrieved by a final decision of the
Board in denying, suspending, revoking or refusing to renew
his certificate of registration, or from any other final
action of the Board, may appeal therefrom [to the Baltimore
City Court, or] to the circuit court of the county in which
he resides or has his principal place of business. All
appeals shall be governed by the provisions of § 255 of
Article 41 (Administrative Procedure Act - Judicial Review).

Article 78 - Public Service Commission Law

89.

The validity of any rule or regulation of the
Commission may be determined upon petition for a declaratory
judgment addressed [to the Superior Court of Baltimore City
or] to the circuit court for the county where the petitioner
has its principal office in this State whenever it appears
that the rule or regulation, or its threatened application,
interferes with or impairs, or threatens to interfere with
or impair, the legal rights or privileges of the petitioner.
The Commission shall be made a party to the proceeding. The
declaratory judgment may be rendered whether or not the
petitioner has first requested the Commission to pass upon
the validity of the rule or regulation in question.
